Please read the following liability statement carefully. With your signatureyou (in the following also "participant") confirm to have taken note of the following liability declaration and the general terms and conditions (GTC) of UP STREAM SURFING. The mentioned GTC were already provided during the booking process and can be viewed at any time online at www.upstreamsurfing.com or directly on site at the surf session.

The safety rules and regulations are binding for all participants, participation in the briefing preceding the surf session is mandatory. The instructions of the staff (including the surf coaches) must always be followed. The use of the UP STREAM SURFING system is always at your own risk and responsibility.

  1. Participation requirements / (special) risks

Participation is generally reserved for persons who have reached the age of 18. The booking/participation of minors requires a written declaration of consent from the legal guardian(s) or their presence during the surf session.

Outdoor and freestyle events inevitably involve certain risks. Participation in the surf sessions requires in any case a very good general health and very good fitness. A certain increased risk of injury is generally to be expected during the surf sessions. The participant is basically responsible for correctly assessing his own fitness before and during the participation in the surf session and, if necessary, to inform the surf coach immediately about (health or other) limitations, pain, problems or the like. This applies to known as well as spontaneously occurring circumstances.

Participation in a surf session under the influence of drugs or alcohol, as well as under the influence of psychotropic drugs is excluded. Participation is also excluded if the participant suffers from high blood pressure, risks in the cardiovascular system, heart problems or epilepsy, pregnancy or the participant had to undergo eye surgery before participation.

When getting on and off the UP STREAM SURFING system and the surfboard, the participant has to be very careful, because in case of slippery stones and different current conditions, the system can move away and there is an increased risk of injury.

  1. Demolition

For reasons of safety, also of the other participants in a surf session, it must be expressly reserved that the surf coaches on site, according to their own professional assessment, may, if necessary, cancel a surf session or refuse further participation to individual participants (for example, in case of problems, safety risks, insufficient own equipment, etc.). Surf sessions can be canceled or changed in the schedule by the organizer even after the start, if weather conditions, currents, the danger of increased flotsam, official measures or requirements, force majeure, safety reasons or other reasons require this.

  1. Rescue operations

If third parties have to be called in to assist the participant (e.g. rescue services), the participant (the participant's accident insurance) must bear the costs incurred or the organizer has the right to collect any costs incurred from the participant.

  1. Liability

The organizer (as well as its organs, employees, representatives, agents or vicarious agents) are not liable for a certain success or result, which the participant may hope for or expect from the surf session. It is expressly pointed out that the results and effects of the same course offer may well vary for different participants due to factors that cannot be controlled (such as physical condition, state of health, fitness).

The organizer (as well as its organs, employees, representatives, agents or vicarious agents) is liable to the participant for property damage only in case of gross negligence or intent - regardless of the legal grounds; the liability for personal injury due to fault is not limited. The organizer (as well as its organs, employees, representatives, agents or vicarious agents) are not liable to the participant for lost property, damage to clothing, material or the like in the context of surf sessions.

  1. Group events

If the participant is the organizer of a group event, he/she shall explicitly bring the General Terms and Conditions of the organizer to the attention of each member of the group. In particular, the participant as the organizer of the group event assures that the group members meet the necessary health and physical requirements.
