Important legal information:

Please read the following declaration of liability carefully. With your signature, you (hereinafter also referred to as "participant") confirm that you have taken note of the following declaration of liability and the General Terms and Conditions (GTC) of UP STREAM SURFING. The aforementioned GTC were already made available during the booking process and can be viewed at any time online at www.upstreamsurfing.com or directly on site at the surf session.
The safety rules and regulations are binding for all participants and participation in the briefing prior to the surf session is mandatory. The instructions of the staff (including the surf coaches) must always be followed. The use of the UP STREAM SURFING system is always at your own risk and responsibility.

  1. Participation requirements / (special) risks

Participation is generally reserved for persons who have reached the age of 18. The booking/participation of minors requires a written declaration of consent from the legal guardian(s) or their presence during the surf session.
Outdoor and freestyle events inevitably involve certain risks. Participation in the surf sessions always requires a very good general state of health and very good fitness. A certain increased risk of injury is generally to be expected during surf sessions. Participants are always responsible for correctly assessing their own fitness before and during the surf session and, if necessary, informing the surf coach immediately of any (health or other) restrictions, pain, problems or similar. This applies to both known and spontaneously occurring circumstances.
Participation in a surf session under the influence of drugs, alcohol or psychotropic medication is not permitted. Participation is also excluded if the participant suffers from high blood pressure, risks to the cardiovascular system, heart problems or epilepsy, is pregnant or has undergone eye surgery prior to participation.
The participant must take particular care when getting on and off the UP STREAM SURFING system and surfboard, as slippery rocks and varying current conditions can cause the system to move and thus increase the risk of injury

  1. Demolition

For reasons of the safety of the other participants in a surf session, the surf coaches on site must expressly reserve the right to cancel a surf session or refuse further participation to individual participants (e.g. in the event of problems, safety risks, insufficient personal equipment, etc.) based on their own professional assessment. Surf sessions can also be aborted by the organizer after the start or changed in the course if weather conditions, currents, the risk of increased flotsam, official measures or requirements, force majeure, safety reasons or other reasons make this necessary.

  1. Rescue measures

If third parties have to be called upon to assist the participant (e.g. rescue services), the costs incurred must be borne by the participant (the participant's accident insurance) or the organizer has the right to collect any costs incurred from the participant.

  1. Liability

The organizer (as well as its organs, employees, representatives, agents or vicarious agents) is not liable for a certain success or a certain result that the participant may hope for or expect from the surf session. It is expressly pointed out that the results and effects of the same course offer may well vary for different participants due to uncontrollable factors (such as physical condition, state of health, fitness).
The organizer (as well as its organs, employees, representatives, agents or vicarious agents) is only liable to the participant for property damage in the event of gross negligence or intent - regardless of the legal basis; liability for personal injury due to fault is not limited. The organizer (and its bodies, employees, representatives, agents or vicarious agents) shall not be liable to the participant for items lost during surf sessions, damage to clothing, material or the like.

  1. Group events

If the participant is the organizer of a group event, he must explicitly inform each member of the group of the organizer's General Terms and Conditions. In particular, the participant as the organizer of the group event shall ensure that the group members meet the necessary health and physical requirements.
